DOJ's watchdog refers Andrew McCabe to U.S. attorney for criminal investigation

The Office of the Inspector General at the U.S. Department of Justice has referred its findings on former FBI Deputy Director Andrew McCabe to the U.S. attorney in Washington for possible criminal prosecution, according to a person familiar with the referral on Thursday.
The Justice Department, the inspector general's office and the United States attorney's office all declined to comment.
Spokesmen for the Justice Department and its inspector general's office declined to comment to Reuters, as did a spokeswoman for McCabe.
The referral, first reported by CNN and the Washington Post, comes almost one week after the inspector general said it had concluded that McCabe had misled investigators over a decision to break with the FBI's standard policy and inform a journalist about an investigation into the Clinton Foundation in 2016.
It was not immediately clear how the D.C. U.S. Attorney's Office responded to the referral, or whether prosecutors there are conducting their own investigation or believe criminal charges are appropriate.
The accusations leveled against McCabe can carry a criminal sentence of up to five years in prison.
Comey's interview came shortly after a source told CNN that the Justice Department would provide Congress with memos Comey had written on his conversations with Trump.
McCabe "definitely did not tell me that he authorized" the leak, Comey told OIG investigators, according to the OIG report. While at the FBI, McCabe played a pivotal role in the investigation into Clinton's emails.

In a Senate hearing in June, he told Congress that "I knew there might come a day when I would need a record of what had happened, not just to defend myself, but to defend the Federal Bureau of Investigation and our integrity as an institution and the independence of our investigative function". The accounts stated Comey and also McCabe gave conflicting accounts.
"The rush to judgment - and the rush to terminate Mr. McCabe - were unprecedented, unseemly, and cruel", Michael Bromwich, an attorney for McCabe, said in a statement.
Trump, for his part, has dismissed Comey's account as he faces scrutiny from political corners, the Justice Department's special counsel investigation and a recently disclosed probe into his personal lawyer Michael Cohen.
