Internet firms gear up for fight to keep "net neutrality"

Under President Barack Obama, Pai was a fringe, frequently outvoted FCC commissioner who repeatedly echoing internet providers' claims that net neutrality would hamper the telecom industry, and argued that the FCC itself was grossly overstepping its bounds.

The announcement by Federal Communications Commission chairman Ajit Pai, appointed by President Donald Trump, signals a new round of wrangling over internet regulatory policy by seeking to reverse rules aimed at avoiding the emergence of "fast" and "slow" lanes at the discretion of carriers.

"These rules, Title II rules were created to regulate Ma Bell, and the promise with Ma Bell, the deal with the government was, we'll give you a monopoly as long as you give universal service to the country".

Getting rid of the 2015 Open Internet Order that gave the FCC greater authority to police broadband companies has been a priority for the newly minted Republican-led FCC as well as Congress. FCC Chairman Pai has said he might agree with the underlying principles of net neutrality but not the power grab by his predecessor and might push tech and broadband industries to take more of a voluntary approach.

In recent quarterly earnings presentations, executives at AT&T, Comcast, and Verizon have all touted their network investments, and just this month, Verizon announced a US$1.05 billion deal to buy fiber from Corning.

Specifically, FCC Chairman Ajit Pai wants to loosen the legal structure that placed Internet service providers under the strictest-ever oversight of the agency, in favor of a "light-touch regulator framework".

Despite Pai's statement that the rules spurred a drop in capital investment, others have said that broadband investment has grown in the last two years.

A group of more than 800 startups, including Etsy, Foursquare and Warby Parker, wrote to Pai on Wednesday urging him to protect "enforceable net neutrality rules", saying America's startup ecosystem depends on them. Republicans generally have opposed the FCC's rule, and offered legislation that Democrats criticized as weakening net neutrality protections. A federal appeals court upheld the rules in 2016 after broadband providers sued. The FCC will then vote on Pai's proposal at its next open meeting on May 18. "But those heights have been threatened by federal regulations that set a risky precedent by focusing on controlling the internet rather than protecting consumers".

There has been no serious or sincere popular outcry for eliminating net neutrality from consumers or from honest advocates for innovation. "Nothing about the law had changed".

Pai, named chairman by Republican President Donald Trump in January, said past year the FCC should have repealed the ban on ownership of a broadcast station and newspaper in the same market, citing the closing of 400 US newspapers, or about a quarter of daily titles, since 1975 as advertising revenue has sharply declined. Ed Markey (D-Mass.), have questioned whether the rules slow investment, pointing to the latest US Census data showing that investments from telecom companies were up from 2014 to 2015.

Opponents of the FCC's regulation also argue that the 2015 decision to classify ISPs as "common carriers" similar to telephone companies violates the FCC's congressional charter and has deterred ISPs from upgrading their networks for fear of direct price regulation by the agency.

"Chairman Pai needs to cease his endless assault on internet freedom and net neutrality", Khanna said.

The FCC's barriers to media consolidation go back to 1975, when the commission banned cross-ownership of a newspaper and broadcast station in the same market unless it granted a waiver, but allowed existing ownership structures to remain in place.
